Welcome to Hotshot Towing & Transport. By using our services, you agree to the following terms and conditions. Please read them carefully before booking any service.
1. DEFINITIONS

“Act” refers to the Carriage of Goods Act 1979.

“Contract” means these terms and conditions as amended from time to time.

“Non-runner” refers to a vehicle that cannot be driven on or off the transport under its own power, including those with defective brakes.

“Transport Rate” includes charges for the requested transport service.

“Transport Service” refers to any service provided by us, including towing, vehicle transport, storage, or any related service.

“Vehicle” includes motor vehicles, machinery, or any item subject to a transport service.

“We,” “our,” or “us” refers to Parks Garage Limited, including its subsidiaries, employees, agents, subcontractors, and actual carriers.

“You” refers to the customer requesting the service, the vehicle owner, and any authorized agent.
2. GENERAL TERMS
2.1. Hotshot Towing & Transport provides towing, vehicle transport, roadside assistance, vehicle storage, and related services.
2.2. All services are subject to availability and may be affected by weather, road conditions, and vehicle accessibility.
2.3. By booking our services, you confirm that you are either the vehicle owner or have legal authorization to act on their behalf.
2.4. We reserve the right to refuse carriage for any person or vehicle at our discretion.
3. TOWING & TRANSPORT
3.1. Vehicles must be in a suitable condition for towing. We may refuse service if the vehicle poses a safety risk.
3.2. Our services include standard, long-distance, emergency, and specialty vehicle transport.
3.3. Customers must provide accurate details about the vehicle’s condition, weight, and towing requirements. Discrepancies may result in additional charges.
3.4. We are not responsible for mechanical failures that occur during or after transport.
3.5. We may use any transport method or subcontract services at our discretion.
4. BREAKDOWN & WINCH RECOVERIES
4.1. Winch recovery is available for vehicles stuck in mud, sand, snow, or off-road locations.
4.2. While we take precautions to minimize damage, recoveries in difficult conditions may result in unavoidable wear or damage.
4.3. Additional charges may apply for extreme conditions, hazardous locations, or specialized equipment use.
5. VEHICLE STORAGE
5.1. Vehicles stored at our facility remain the property of the owner. We are not liable for mechanical failures, deterioration, or pre-existing damage.
5.2. Storage fees must be paid in advance. Late payments may result in additional charges or vehicle removal.
5.3. While we offer 24/7 security, we are not responsible for theft, fire, vandalism, or natural disasters.
5.4. Additional services such as cleaning, battery checks, and WOF/Rego handling are available upon request and may incur extra charges.
6. PAYMENT & CHARGES
6.1. All services must be paid in full upon completion unless prior arrangements have been made.
6.2. Payment options include cash, EFTPOS, credit card, or direct transfer.
6.3. Cancellations made within 48 hours of a scheduled service may be subject to a cancellation fee.
6.4. Unpaid invoices may result in collection fees, legal action, or vehicle impoundment where applicable.
6.5. We may charge for failed pickups, delivery delays exceeding 30 minutes, or unnecessary wait times at an hourly rate.
7. LIABILITY & INSURANCE
7.1. While we take precautions to handle vehicles with care, we are not responsible for pre-existing damage, minor scratches, or mechanical issues arising before, during, or after transport.
7.2. Hotshot Towing & Transport carries industry-standard insurance, but customers are advised to have their own coverage for added protection.
7.3. Customers must report any concerns within 24 hours of service completion.
7.4. We are not liable for indirect or consequential loss, including delays.
8. CUSTOMER RESPONSIBILITIES
8.1. Customers must ensure vehicle accessibility and provide necessary keys, documents, or instructions.
8.2. Personal belongings left in the vehicle are the customer’s responsibility. We are not liable for lost, stolen, or damaged items.
8.3. Any aggressive behavior, threats, or abuse toward our staff will not be tolerated and may result in service refusal.
8.4. Vehicles with low ground clearance (under 150mm) or extensive modifications must be disclosed before booking.
9. DAMAGE EXCLUSIONS
We do not accept liability for:

Damage from leaking fluids, battery acids, or industrial fallout.

Damage caused by acts of war, civil unrest, or natural disasters.

Hidden damage undetectable at pickup due to dirt or weather conditions.

Mechanical, electrical, suspension, or exhaust system failures.

Loss of aftermarket accessories (e.g., custom audio/video equipment, non-retractable antennas).

Road debris damage (e.g., stone chips, broken windscreens).

Damage to vehicles classified as non-runners or those already in a damaged state upon pickup.
10. AMENDMENTS & CHANGES
10.1. Hotshot Towing & Transport reserves the right to update these Terms & Conditions at any time.
10.2. Continued use of our services after changes are made constitutes acceptance of the revised terms.
